Privacy Policy

1 Introduction

Max 909 FM. (hereafter “Max FM,” “we,” or “us” or “our”) has worked hard to bring you informative and user-friendly mobile applications that are sensitive to concerns about privacy. We have designed this Mobile App Privacy Policy (the “Policy”) to explain how and when Max FM collects, uses, and safeguards the information you provide and that we collect through the mobile or web-based applications owned and offered for download by Max FM any other mobile applications that we may develop and offer in the future (collectively, the “Apps” and individually, an “App”).

Please carefully review this Policy to understand our policies and practices regarding the collection, use and treatment of your information. By using, accessing, or registering with an App, you consent to our collection, use, and disclosure of information in accordance with this Policy. You also acknowledge and agree that your access to and use of our Apps is subject to our Terms of Use and any conflict between this Policy and the Terms of Use will be determined in favor of the Terms of Use. The Terms of Use are expressly made a part of this Policy. You also acknowledge and agree that we are not responsible for how third parties, vendors, and service providers collect or use your information.

2. Scope of this Policy

This Policy applies to information you provide to us or that we collect automatically when you visit, access, use, or register with one or more Apps and when you interact with App content or applications that may link to or be accessible from or on the App that are provided or managed by a third party. This Policy does not apply to information we collect when you visit or use the Max FM Website or otherwise, such as when you communicate with us through email, text, or other electronic means. For information regarding how we collect and use information when you visit or use the Max FM Website, including web-based pages accessible through our Apps, please refer to our Website Privacy Policy.

This Policy will tell you:

Who collects information;
What types of information are collected and how this is done;
How Max FMuses and discloses the information that is collected;
Your rights to view and correct information that you voluntarily submit to us;
How Max FM secures your information;
How we comply with the Children’s Online Privacy Protection Act; and
Where you can get answers to your questions about this Policy.
3. Who Collects Information

When you visit or use our Apps we may collect or receive information about you as described in this Policy. Some Apps may include links to the Max FM Website, including third-party managed pages on the Max FM Website. For example, the App may link to an Max FM web page providing health information or a third-party managed Max FM web page for conference registration. If you navigate to the Max FM Website, Max FM’s Website Privacy Policy governs the collection of information while you use the Max FMWebsite.

Some Apps may also make use of third-party Cookies, Web Beacons, Pixels, dynamic tags, and/or other technical means, which may allow third parties to collect information about you and your activities on the App or the Max FM Website and provide you, or enable others to provide you, with certain functionality or advertising.

Third-Party Providers. Some of our Apps or the functions within the Apps may be provided, developed, or hosted by third parties that are not affiliated with Max FM. These entities may collect or receive information you provide within the Apps, including information about your use of our Apps and your activities over time and across third-party applications or websites. These third parties may collect, use, store, or transmit information in accordance with their applicable privacy policies and business practices, which are not under Max FM’s control. For more information on third party practices, please refer to such third parties’ applicable privacy policies, terms of use, end user license agreements, or similar disclosures, available from such App, the Apple App Store or Google Play Store, or by contacting the third party for more information. If you have questions about which third parties may have access to your information through your access to or use of any particular App, you may contact us at privacy@Max FM.org for more information.

Links to External Websites. Some Apps may include links to external websites not operated or controlled by Max FM. For example, an App may link to a third-party website that allows you to submit information to obtain continuing education credits. Please be aware that Max FM does not have control of and is not responsible for the privacy or security practices of such other sites. We encourage you to look for and review the privacy statements of each and every website that you visit and be mindful of the information you may submit to any such third party.

4. Types of Information Collected by Max FM

Information You Provide Directly. You may provide information to us when you use our Apps, including when you download, register with, or log into our Apps. This information may include, but is not limited to, your Personally Identifiable Information (“PII”) including, name, email address, phone number, mailing or billing address, device ID, username and password, registration ID number, and other information that may identify you. You may also provide Non-Personal Information (“NPI”), such as terms used for searches within Apps, responses to questions, schedules, bookmarks, notes, content viewed, features used, and other information about your activities within and usage of the Apps. Unless otherwise noted within an App or in this Policy, any information you provide through the App may be transmitted to or stored by Max FM and/or its third-party providers.

Certain information you provide when you use our Apps and their respective features may be stored locally on your mobile device. The scope of information you may store locally on your mobile device varies by App. While Max FM does not transmit information stored locally on your mobile device through use of our Apps, please be aware that any information stored on your mobile device may leave your mobile device through automatic backup processes, manual download from your mobile device, and through other means outside of Max FM’s control. In addition, your activities on your mobile device outside of the Apps may result in such information being transmitted to or otherwise collected by authorized or unauthorized third-parties, including through the other apps you access, the websites you visit, and by parties who may gain unauthorized access to your mobile device or data. Any information stored on your mobile device or transmitted over the Internet or any data network could be accessed or intercepted by unauthorized third parties. As a result, you acknowledge that Max FM cannot assure that the information you submit through the Apps or store locally on your mobile device will remain private. Any data you provide or store locally through the Apps is at your own risk. Please see Cancer.Net below for more information specific to our Cancer.Net App.

Information We Collect Automatically. If you download, access, or use our Apps, we may receive and store certain information about you and your mobile device(s) automatically using automatic data collection technologies, including but not limited to first- and third-party Cookies, log files, Web Beacons, Pixels, dynamic tag management and other technical means. This information may include:

The location of your mobile device;
Your mobile device ID and call information;
The type of mobile device and operating system you use to access our Apps;
Your IP address;
Information associated with your Internet or mobile service provider or your account with your Internet or mobile service provider;
Information associated with your Apple iTunes or Google Play accounts or any other account use to download or access the Apps;
The specific Apps you use, content you view and/or download, search terms you enter, features you use, and the date and time of your visits;
Information about the webpages you visit from our Apps or before you came to or after you leave our Apps; and
Information collected by third-party advertisements on our Apps, from third parties providing services to us, and from third parties with whom TVC advertises.
5. How We Use Your Information

We may use the information we collect or receive about you to:

Provide our Apps and their content to you;
Complete your requested registrations, transactions or subscriptions;
Contact you in connection with requested services or inquiries;
Personalize the content and features you see when you visit our Apps or the Max FMWebsite;
Enable us and our advertisers and social media partners to display advertisements to you and appropriate target audience(s) and for other marketing and advertising purposes, including through Online Behavioral Advertising;
Improve the content and functionality of our Apps and the Max FM Website;
Track our users’ demographics, interests, and behaviors;
Track the total number of visitors to our Apps and to each page or feature of our Apps; and
For other commercially reasonable purposes, including but not limited to, measuring advertising and promotional effectiveness and assessing which areas to remarket to you after you leave the App.
Use of Third-Party Cookies and Other Tracking Technologies for Advertising.

Our Apps use automatic data collection technologies including first- and third-party Cookies, log files, Web Beacons, Pixels, dynamic tags, and other technical means. We may use these technologies to collect information about your online activities over time and across third-party websites or other online services in order to deliver content and advertising tailored to your interests, both on our Apps and on third-party applications (including but not limited to search engines and social media applications). This practice is commonly known as Online Behavioral Advertising.

The third parties who provide us with third-party Cookies, Web Beacons, Pixels, dynamic tags, and other tracking technologies, may use these technologies to collect information about you when you use the App in order to provide you with advertising based on your use of the App and to track performance of their advertising. Third parties may have the ability to link the information they collect about you when you use the App with other information they collect about you elsewhere on the Internet, including but not limited to your PII or information about the mobile device you are using. Third parties may also collect information about your online or application activities over time and across different websites, applications, and other online services and may use this information to provide you with Online Behavioral Advertising or other targeted content.

Social Networking. Max FM maintains a presence on third-party social networking sites such as Facebook, LinkedIn, Twitter, and others. Max FM does not control and is not responsible for the collection, tracking, use, or disclosure of your information (including your PII and NPI) gathered through social networking websites and applications, including through the Max FM pages or profiles within other applications, or otherwise as a result of your participation in social networking sites. Third-party social networking applications and advertisers on these applications, including on the Max FM pages or profiles within these sites, are not obligated to follow or apply this Policy or the Terms of Use. If you have any questions about an advertisement or other targeted content, you should contact the responsible social networking provider directly and refer to the applicable privacy policy and terms of use of that social networking provider.

We encourage you to research and learn about Cookies and other technical means, including Web Beacons, Pixels, and dynamic tags, through which information about you may be collected through the applications and websites you visit. We encourage you to review the privacy policies of every third-party website or service that you visit or use, including those third-parties you interact with through our services.

We may use your information for any other purpose disclosed to you at the time we collect or receive the information, or otherwise with your consent. For information about how to opt out of the use of some of these technologies, see Section 7: Your Choices.

6. How We Share Your Information

We may share your information with our subsidiaries and corporate affiliates, as well as entities that provide services to us, including companies that provide payment processing, conference registration, app analytics, data processing, IT services including app development and maintenance, and other services. We may also disclose without restriction NPI or aggregate, anonymous information to third-party service providers without restriction. Information you submit to the Max FM Membership Directory may be shared with other Max FM members and third-parties providing membership services. Your PII may be shared with other meeting or conference attendees using the Max FM App, and other meeting or conference attendees may use the Max FM App to contact you, including by email.

Disclosure of Information to Third-Party Vendors and Service Providers. Max FM may engage third-party vendors and service providers to provide services in connection with our Apps, outreach for our programs and services, and to help us manage our digital presence and allow us to better serve our users.

In addition, some of the content and services on our Apps, including advertisements, are served by third-parties, including advertisers, ad networks and servers, content providers, and technology and application providers. We may share PII, NPI, or other information (including, without limitation, the number of times an advertisement has been serviced, click information, and geographic limitations) with such third-parties as necessary so that they may provide the services for which they have been engaged.

When Required By Law. We may disclose your information to third parties when required to protect and defend our legal rights, protect the safety and security of our users, prevent fraud, comply with the law or respond to legal process or a request for cooperation by a government entity.

Corporate Transactions. In the event of sale, transfer, merger, reorganization, dissolution, or similar event we may transfer your information to one or more third parties as part of that transaction.

With Your Consent. We may share your information with other third parties when you consent to such sharing.

7. Your Choices

If you have registered with our Apps, you may access, modify, or delete your PII by logging into our Apps using your username and password and visiting your account profile page. You may also send us an email at privacy@Max FM.org to request correction or deletion of any PII that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. If you withdraw a registration or cancel a subscription we may retain your PII in our records and we may continue to use and disclose that data in a manner consistent with this Policy, unless you request deletion of it.

Notifications and Location Services. When you access our Apps, you may be asked whether you will allow us to access your location while you are not using the app and/or whether you would like to receive notifications on your mobile device. If you click “allow” but change your mind at any time in the future and no longer wish to allow us to access your location and/or to receive notifications, you will be able to opt-out by updating the privacy settings on your mobile device.

Cookies. You may set your mobile device to refuse all or some Cookies. If you disable or refuse Cookies, please note that some parts of our Apps may not function properly, or may no longer be accessible.

California Do Not Track Disclosure. Max FM does not have a mechanism in place for responding to browser “do not track” signals or other similar mechanisms used to limit collection of information for use in Online Behavioral Advertising.

8. Security

Max FM has implemented reasonable security measures designed to protect the information collected via our Apps from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Access to data and technology relating to user information is password-protected and limited to authorized personnel and those vendors that require access to the information in order to furnish services to Max FM and our members. In addition, Max FM uses industry standard technology to keep users’ information secure while residing on Max FM’s servers. However, despite these measures, our IT systems could be compromised by parties seeking unauthorized access to our data or users’ data, by a technological malfunction or by an error by an employee, vendor or contractor. In addition, the transmission of information via the Internet or mobile data networks could be intercepted by third parties. As a result, our efforts to protect our data and users’ data from unauthorized access may be unsuccessful and we cannot assure you that the security measures we have adopted will provide absolute certainty. By using, accessing or registering with the Apps, you agree that Max FMis not responsible or liable for any loss or damage of any sort arising from or relating to any breach of our security, circumvention of any privacy settings or security measures, or interception of your transmissions (see also Terms of Use). Any transmission by you is at your own risk.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to our Apps or certain functions within our Apps, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

9. Children’s Information

Our Services are not intended for children under 13 years of age and we do not knowingly collect personal information from children under the age of 13. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personally identifiable information to us please contact us at privacy@TVC.org. A parent or guardian of a child under age 13 may review and request deletion of the child’s personal information.

10. International Users

Max FM is based in the Nigeria and, regardless of where you use our Apps, the information collected as part of that use will be transferred to and maintained on servers located in the Max FM. Any information we obtain about you will be stored in accordance with  privacy laws, regulations, and standards, which may not be equivalent to the laws in your country of residence. By using our Apps, you consent to this collection, transfer, storage, and processing of information to and in the United States in accordance with the foregoing.

11. Changes to This Policy

We reserve the right to update or modify our Apps or this Policy at any time and from time to time without prior notice. Any revisions to this Policy will be effective upon posting. The most recent version of this Policy is available at Max FM.org/about-Max FM/legal/mobile-app-privacy-policy. You should review this Policy periodically to ensure you are aware of any changes. If you object to any changes to this Policy, you must cease using our Apps. Please review this Policy periodically by visiting the App or the applicable App Store or Google Play Store. This Policy was last updated on the date indicated at the top of this page. Your continued use of our Apps after any changes or revisions to this Policy indicates your agreement to the terms of the revised Policy.

12. Cancer.Net App. Our Cancer.Net app includes features enabling users to locally store information concerning their health on their mobile devices. Such information may include, without limitation, information you provide regarding your symptoms and medications, voice recordings you create and save to the App, and reminders or calendar events for medical purposes that you submit or store through the App. Max FM does not transmit, store remotely, or backup any such information; however, please be aware that any information stored on your mobile device may leave your mobile device through automatic backup processes, manual download from your mobile device, and through other means outside of Max FM’s control. In addition, your activities on your mobile device outside of the Cancer.Net App may result in such information being transmitted to or otherwise collected by authorized or unauthorized third-parties, including through the other apps you access, the websites you visit, and by parties who may gain unauthorized access to your mobile device or data. Any information stored on your mobile device or transmitted over the Internet or any data network could be accessed or intercepted by unauthorized third-parties. As a result, you acknowledge that Max FM cannot assure that the information you choose to store locally on your mobile device in connection with the Cancer.Net App will remain private. Any data you provide through or store locally regarding the Cancer.Net App is at your own risk.

14. Glossary

Aggregate Information. Non-Personal Information, or Personally Identifiable Information that has been de-identified, and that is combined with similar data related to more than one individual to form aggregated information. For example, we may add up the total number of people in Peoria, Illinois (but not their names) who are seeking information about pancreatic cancer and compare that to the number of people in Petaluma, California seeking the same information. This sort of statistical information is called Aggregate Information because it reflects the habits and characteristics of an anonymous group of people. Companies may use aggregate data or share it with third parties so that the information and services provided best meet the needs of their users. Aggregate Information also helps advertisers and sponsors know how effectively they are reaching and meeting the needs of their target audience.

App(s). See Section 1.

Cookie. A small data file that is stored on the mobile device you use to view an App. Cookies are placed by the application (“first-party”) or by a third-party with a presence on the application (“third-party”), such as an advertiser using a Web Beacon, and are generally accessed only by the party or application that placed the Cookie on the mobile device (i.e., a Cookie placed on your mobile device by Max FM is generally not accessed by any other application you use but a Cookie placed on your mobile device by an advertiser may be accessed by any application on which that same advertiser has a presence). Cookies can contain pieces of Personally Identifiable Information. Cookies often are used to make the application easier to use. For example, if you check a box to ask that we store your username on your mobile device so that you do not have to enter it each time you visit the site, this can be stored in a locally accessible Cookie on your mobile device. Cookies may be persistent (meaning that they are saved on your mobile device even after you close the application and may be accessed at a later time) or non-persistent (meaning that they are deleted when you close the application). Cookies may be “essential” for the use of an application, such as for example session-id cookies, authentication cookies or user centric security cookies, or “non-essential” for the use of an application, such as for example, third-party advertising cookies or other tracking cookies.

Non-Personal Information (“NPI”). Information that may relate to an individual but does not by itself identify that individual. For example, information such as gender, age, city, and physical location, mobile device ID and call information, information regarding the type of mobile device and operating system you use, your IP address, information regarding your Internet or mobile service provider, terms used for searches within Apps, responses to questions, schedules, bookmarks, notes, and other information about your activities within and usage of the Apps or webpages you visit before and after using our Apps, when not linked with other Personally Identifiable Information. NPI may be “re-identified” through certain processes by linking it to PII relating to the same individual.

Online Behavioral Advertising. The practice of using online tracking technologies such as cookies and web beacons to collect information about a user’s online activities over time and/or across websites and mobile applications, including third-party websites and mobile applications, or other online services in order to deliver advertising and content tailored to the user’s apparent interests.

Personally Identifiable Information (“PII”). Information that identifies or is uniquely associated with an individual, such as a name, tax payer identification number, home address, telephone number, email address, Social Security number, or credit card number.

Web Beacons or Pixels (also often referred to as “clear GIFs,” “pixel tags,” “1-by-1 GIFs,” “Single-Pixel GIFs,” “1 x 1 Pixels” or “clear Pixels”). Pages of our Apps and our emails may contain small electronic files known as Web Beacons that permit us and/or third parties to collect information during your use of the Apps. For example, Web Beacons may be used to count the number of users who have visited a page of our App or opened an email and for other related application statistics (for example, recording the popularity of certain application content and verifying system and server integrity). Web Beacons send information back to their home Server (which can belong to the host site, a network advertiser, or some other third party) from the users’ application, such as the IP address, the URL of the page on which the beacon is located, hardware identification information (depending on the type of mobile device that is accessing the application), and information stored in any Cookies on the users’ mobile device previously placed by that Server. Web Beacons can also be used to place a Cookie on an application or device. Third parties who provide us with Web Beacons or Pixels may have the ability to link the information they collect about you when you use our Apps with other information they collect about you elsewhere on the Internet, including but not limited to your PII or information about the mobile device you are using.
